General Terms and Conditions
This document contains the General Terms and Conditions governing the purchase of stays made remotely via computer network and thus the contract that is concluded with users of the site Jhotel.euIn any case, the use of the online booking system contained in the said site implies the acceptance and in any case the application of these general conditions.
J hotel reserves the right to modify the same Conditions without notice.
Acceptance of the General Conditions of Sale.
With the use of the online booking service and with the telematic submission of the purchase order, the Guest unconditionally accepts and undertakes to observe these General Conditions, declaring that he/she has read and accepted all the indications contained therein in accordance with the above-mentioned regulations and also noting that J hotel will not be bound to different conditions unless previously agreed in writing. Any nullity or invalidity, in whole or in part, of one or more articles of these General Conditions shall in no way affect the validity of the other articles contained in the contract, which shall be considered valid and effective.Guest commitments.
a. Submission of the reservation request implies full knowledge of the same Conditions and their full acceptance.b. The Guest undertakes and is obliged, once the online purchase procedure is completed, to print and keep these Conditions, already viewed and accepted during the booking process, in order to fully satisfy the condition set forth in Articles 52 and 53 of Legislative Decree No. 206/2005.
c. To purchase J hotel stay services, you must be at least 18 years old or be of legal age according to the laws of the country of which you are a citizen. However, any properly completed reservations, even if made by minors, interdicted or incapacitated persons, will still be fully valid and effective.
Mode of purchase.
On the Jhotel.eu website the different accommodations available from time to time are described with the relevant treatment, the relevant rates and special conditions (including that relating to deposits, payments, cancellation of reservation, etc.).These rates include VAT (except in cases of increase in the relevant rate, cases in which the Guest is required to pay the relevant difference) but do not include any taxes due under local regulations, such as the Italian tourist tax, which must be paid directly at the Hotel.
b. The Guest will choose from among the different accommodations available the one of his/her liking according to the relevant rate and special conditions indicated at the time of reservation, which are accepted at the time the purchase order is submitted.
Prior to placing such order and thus prior to confirming the reservation request, the Guest will be summarized the total cost of the services requested; the Guest is required to check such summary before proceeding to payment (if provided by the chosen rate) or releasing credit card details as a guarantee.
Depending on the rate chosen by the Guest, when placing the purchase order, the same Guest will be asked to choose the method of payment (including Bank Transfer, Credit Card, etc.) or to enter the details of a credit card as a guarantee of the exact fulfillment of the obligations of the Guest.
After submitting the said purchase order (or, according to the provisions of the chosen tariff, after making the payment of the amount indicated in the services summary or of a deposit/deposit, or after entering the details of the credit card as a guarantee) the Guest will receive an e-mail message at the address indicated by the same Guest containing the summary of his/her order, the reservation number, the specifications of the booked service and the conditions of its cancellation.
Conclusion of the contract
The contract is concluded with the acceptance of the purchase/booking order by the J hotel.Depending on the different rate chosen, only upon the successful completion of the expected payment or credit card indicated as guarantee will the reservation be definitively confirmed by the J hotel. In the absence of such successful completion, the Guest shall have no claim.
Exclusion of the right of withdrawal
Article 47 of Legislative Decree no. 206 of 6 September 2005, known as the “Consumer Code”, expressly excludes the applicability of the discipline of contracts concluded away from business premises, distance contracts and the related right of withdrawal to contracts that fall within the scope of application of the discipline concerning travel, holidays and “all-inclusive” circuits.Penalties in case of cancellation or early departure
In the special conditions relating to the type of accommodation/rate chosen - conditions that can be consulted prior to purchase on the Jhotel.eu website - any penalties that will be applied in case of cancellation/cancellation of the reservation by the Guest are also indicated.In case of early departure, the facility is entitled to the payment of the entire booked period.
Refunds
Any refunds due to the Guest shall be made by the same means of payment used by the Guest to purchase the service.Beginning and end of stay. Treatment.
In all hotel facilities, rooms are available from 2 p.m. on the day of arrival and must be released by 10 a.m. on the day of departure. Any early accommodation or room release later than the said times are subject to the payment of a surcharge on site.The Guest who booked half-board accommodation is entitled to breakfast and dinner. For the full-board Guest, treatment usually begins with dinner on the first day and ends with lunch on the last day.
No reductions can be obtained for meals included and not taken for any reason.
Reports at the time of booking
Any special requests or preferences that may be indicated by the Guest in relation to the rooms (such as: nearby room, on the ground floor, with double beds, etc.) are not binding on the hotel, which will be free to accommodate them or not.Guest Rights.
The Guest, whose reservation has been regularly confirmed by J hotel and then paid according to the chosen rate, has the right to regularly use the booked services even if in compliance with the regulations of the accommodation facility.Obligations of the Guest.
The Guest is obliged, at the latest at the time of departure, to pay all fees due, including additional fees, related to extra services/performances enjoyed by the same Guest and/or the persons accompanying him/her, in addition to the tourist tax if applicable; the credit card indicated as a guarantee at the time of booking may be used by the Hotel for the payment of all fees due to it, including additional fees.The Guest shall also be liable for any damage suffered by the property or third parties, including other Guests, caused by him or caused by persons for whom he is responsible.
Hotel rights
If the guest refuses to pay the fees due, including for additional services purchased on site, J hotel, in addition to being able to use the credit card indicated as a guarantee when making the reservation, under Article 2760 of the Civil Code will also have the right of retention and lien on the guest's belongings located in the hotel.Obligations of the hotel
The hotel is obliged to provide the booked and confirmed services and facilities in a manner corresponding to its standard.The hotel may provide the Guest with suitable substitute accommodation (of equal quality), by way of example but not limited to, in the event of an uninhabitable room, in the event of an extension of the stay of the previous occupants of the room in question, in the event of overbooking, and in all cases in which the hotel's needs dictate such a substitution.
Any additional costs associated with the replacement accommodation shall be borne by the hotel.
Liability for property damage
J hotel shall be liable for damages suffered by the Guest only if the damage occurred on the hotel premises and the hotel or its employees are responsible for it.If and insofar as it fails to prove that the damage was not caused by the hotel, its employees or persons frequenting the premises, J hotel shall be liable for things brought onto the premises by the Guest up to a maximum amount equivalent to one hundred times the daily price paid, even in the event of deterioration, destruction or misappropriation of property, valuables, money and securities.
However, J hotel shall not be liable when the damage or misappropriation has occurred due to the Guest's act, force majeure, or the nature of the thing.
Custody of items may be refused if they are dangerous (i.e., potentially capable of causing damage), too bulky, or of excessive value.
Things are considered to have been brought into the facility at the time they are taken over by a member of the accommodation establishment's staff or are brought to a place, within the accommodation establishment, designated for their safekeeping.
The Guest must report the fact without undue delay to the management of the facility in order not to lose the right to compensation (Art. 1785 ter Civil Code).
Maintenance
J hotel reserves the right to make changes and perform maintenance, including extraordinary maintenance, to the facilities, even during the period of opening to the public. As part of the necessary maintenance activities, the Guest will consent, without being entitled to claim refunds and/or compensation, to work being carried out in the rooms or other parts of the accommodation during his/her stay at the accommodation.Animals
Small dogs and cats are welcome inside the J hotel.Extension of stay
The Guest may not claim an extension of the stay, which must always be requested in advance and then expressly accepted by J hotel.If the Guest is unable to leave the Hotel on the scheduled date due to exceptional and extraordinary and unforeseeable circumstances (e.g. in case of natural disasters, floods, strikes, etc.) and he/she is objectively precluded from all opportunities to travel, the stay will be automatically extended for the duration of the impediment, even at other accommodation indicated by J hotel.
The latter is entitled in such cases to charge as consideration at least the price charged in the low season.
Termination of contract as of right - Supervening inability of J hotel.
The Hotel may terminate the contract with immediate effect if the Guest:uses the premises with serious detriment to the property or makes coexistence with other guests intolerable by behaving in an overbearing, rude, disrespectful, scandalous or in any case inconsiderate manner or is guilty of actions or omissions towards J hotel, staff, other guests and/or persons in the hotel, punishable by law as a crime
in the event that he/she is suffering from a contagious disease or illness whose course exceeds the agreed period of stay or in the event that special care is required.
If the enjoyment of the stay is not possible due to events of force majeure (e.g., natural disaster, strike, lockout, order of the Authorities, etc.), J hotel may terminate the contract at any time without prior notice and without any claims for damages and/or compensation from the Guest.
Complaints
If the Guest is not satisfied with the services provided, the relevant complaint must necessarily be reported without delay on the spot and directly to the Management of the facility.Applicable law and jurisdiction
These terms and conditions, as well as the relationship between the Guest and J hotelare however governed by Italian Law.For any and all disputes that may arise between the Guest and J hotel, the Court of Turin shall have exclusive jurisdiction, to the exclusion of any other court that may have jurisdiction.
